Terms and Conditions

This is an English translation of our Czech terms and conditions, provided for your convenience. The legally binding version is the Czech one — if the two ever differ, the Czech version prevails.

1. Who we are

These terms and conditions govern the sale of goods through the online shop at mechanito.cz between the seller and the buyer.

2. Placing an order and concluding the contract

You choose goods by adding them to the cart and send the order by filling in the form. Before sending, you can review the order and correct it.

By sending the order you make us an offer to conclude a purchase contract. The contract is concluded at the moment we send the order confirmation to the e-mail address you provided. The contract is concluded in Czech and we archive it in electronic form.

We may decline an order — for example when the goods are out of stock or are listed at an obviously wrong price. In that case we will get in touch and refund any money you have already paid.

3. Prices and payment

We are not VAT payers. The prices shown are final, in Czech crowns (CZK) — no tax is added to them. The shipping price and any surcharge for the chosen payment method are added to the price of the goods; you will see both before you send the order.

The quantity discount is calculated automatically from the number of pieces in the cart (2 pieces −5 %, 3 pieces −10 %, 5 or more pieces −15 %). Discounts cannot be combined with other promotions unless stated otherwise.

Payment methods

Online payments are provided by the Comgate payment gateway. The service provider, Comgate a.s., is a licensed payment institution operating under the supervision of the Czech National Bank. Payments made through the payment gateway are fully secured and all information is encrypted. More information at www.comgate.eu. 4. Delivery

We ship with Zásilkovna (Packeta) to the pickup point you choose on the map in the order, or by Zásilkovna courier to your address. Personal handover in Prague is also possible by arrangement.

Orders received by 12:00 on a business day are dispatched the same day, others on the next business day. For bank transfers, the period runs from the moment the payment is credited.

Please inspect the parcel when you collect it. If the packaging is damaged, write up a damage report with the carrier and let us know.

The risk of damage to the goods passes to you when you take over the parcel.

5. Withdrawal from the contract within 14 days

If you buy as a consumer, you may withdraw from the contract within 14 days of the day you received the goods — and you do not have to give a reason.

All you need to do is send us a notice within this period to k.boehmova@gmail.com. You may use our model withdrawal form (in Czech; it can be sent by e-mail or printed), but you do not have to.

Send the goods back to us no later than 14 days after withdrawing, to Pod radnicí 657/2c, 150 00 Praha 5, Czech Republic. You bear the cost of returning the goods.

We will refund the money — including the delivery cost up to the cheapest delivery option we offer — within 14 days of your withdrawal, using the same method by which we received it. We may hold back the refund until we receive the goods back or until you prove that you have sent them.

If you return goods that are used or damaged beyond normal trying out, we are entitled to compensation for the reduction in their value.

6. Complaints and warranty

We are responsible for the goods being free of defects when you receive them. As a consumer, you can report a defect within two years of receipt.

Make a complaint by e-mail to k.boehmova@gmail.com or by sending the goods to Pod radnicí 657/2c, 150 00 Praha 5, Czech Republic. Please describe the defect and what you are asking for.

We will settle the complaint within 30 days at the latest. You may ask for a repair or a new piece; if that is not possible or reasonable, you are entitled to a discount or to withdraw from the contract.

The warranty does not cover wear from normal use or defects caused by careless handling. The critters are mechanical toys — winding the spring past its stop is handling that can cause a defect.

7. Dispute resolution

If we cannot reach an agreement, as a consumer you have the right to out-of-court dispute resolution. The competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce) — information and the application form are available at coi.gov.cz/informace-o-adr (in Czech). You can file the application within one year of the day you first exercised your right with us.

8. Final provisions

Matters not covered by these terms are governed by Czech law, in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection.

We may change these terms. An order that has already been placed is always governed by the version in effect at the moment it was sent.
